Overview
Podkey is operated by Jolly Code LLC. These Terms govern your use of the Podkey service, including Podkey accounts, generated podcast feeds, hosted content, subscriptions, and related services. If you download the Podkey app from Apple's App Store, your license to the app itself is governed by Apple's Standard Licensed Application End User License Agreement unless Podkey provides a separate custom EULA through App Store Connect. These Terms supplement that app license and govern the Podkey service.
By using Podkey, you agree to these Terms and acknowledge our Privacy Policy.
Accounts
You are responsible for the activity on your account and for keeping your sign-in method secure. You may delete your account from Settings in the Podkey app. Account deletion does not cancel an active Apple subscription.
Source Rights and Generated Content
Podkey generates podcast episodes from sources, prompts, artwork, feed settings, and other materials you choose. You are responsible for the feeds you create, the sources you select, and your use or sharing of generated content. You represent that you have the rights and permissions needed for Podkey to process the materials you submit or select and to generate, host, publish, and deliver the resulting feeds and media at your direction.
Do not use Podkey to violate rights, impersonate people, create non-consensual voice clones, produce unlawful, abusive, or misleading content, or interfere with the security or operation of Podkey or third-party services.
Generated content may contain errors, omissions, or unexpected output. You should review generated content before relying on it, publishing it, or sharing it.
No Professional Advice
Podkey is an informational and entertainment service. Podkey does not provide legal, financial, investment, tax, medical, health, mental-health, safety, or other professional advice, and Podkey is not acting as your professional adviser. Generated content may summarize, discuss, or reference professional topics, but it is not a substitute for advice from a qualified professional.
You should not make decisions based solely on Podkey content. You are responsible for reviewing generated content and consulting appropriate professionals before relying on it for any decision that could affect your rights, finances, health, safety, or obligations.
License to Operate Podkey
You keep any rights you have in materials you provide and content generated for your account. You grant Podkey a limited, non-exclusive, worldwide license to host, store, copy, process, transform, publish, distribute, display, and otherwise use those materials and generated outputs as needed to provide, operate, secure, support, and enforce the Podkey service, including delivering RSS feeds and media files. This license ends when the materials are deleted from Podkey, except where continued retention is needed for backups, security, legal, dispute, refund, fraud-prevention, or operational records.
Subscriptions
Podkey may offer auto-renewing subscriptions through Apple. Subscription prices, durations, and included features are shown before purchase. Your Apple ID account will be charged at confirmation of purchase. Your subscription renews automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple account settings.
Apple handles App Store billing, renewals, cancellations, and refunds. Podkey account deletion does not cancel an active Apple subscription. Refund requests should be made through Apple.
Copyright and Takedown Requests
If you believe content on Podkey infringes your rights, contact Podkey with enough detail to identify the content and explain the issue. We may remove or disable access to content when needed to address rights, safety, security, legal, or abuse concerns.
Service Changes and Enforcement
We may change, suspend, or discontinue features when needed to operate, secure, or improve Podkey. We may limit or remove access if use of the service violates these Terms or creates risk for Podkey, users, providers, or third parties.
Disclaimers and Liability
Podkey is provided AS IS and AS AVAILABLE. To the fullest extent permitted by law, Podkey disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Podkey is not responsible for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption arising from your use of the service.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by email, in-app notice, or updating this page before the changes take effect. If a change materially affects your rights or obligations, we may ask you to accept the updated Terms before continuing to use Podkey. If you do not agree to updated Terms, you should stop using Podkey and, if applicable, cancel your subscription through Apple.
